MLS Rules Update – July 2018

We have updated our MLS rules to reflect policy changes adopted by the National Association of REALTORS®. This four-minute video covers what you need to know!

Summary of Changes

These latest rule revisions were required to comply with changes to NAR MLS Policy Statement 7.42 (Jurisdiction of Association Multiple Listing Services) and MLS Policy Statement 7.43 (Waivers of MLS Fees, Dues and Changes).

Previously, an MLS could require an agent under a subscribing broker to also subscribe to the MLS, regardless of whether the agent needed to use that specific MLS. This was a problem for agents who were under brokers who were members of more than one MLS, as they would have to subscribe to all of the MLSs to which his or her broker subscribed.

With these latest policy changes, an agent under a broker who is a member of multiple MLSs has the option to sign up with only one of those MLSs and not have to sign up with all of them.

To support this change, MLSs are required to provide no-cost waivers to agents if the agents can demonstrate that they have a subscription to another MLS. Our rules now include a new section (13.05) that explains the eligibility for such waivers, the processes involved in obtaining waivers, and the conditions that apply to agents while they are on waiver.

What Changes at HIS?

We have revised our waiver application form to accommodate agents who are members of another MLS, as well agents who work in a specialized field of real estate that does not involve the sale or appraisal of real estate such as property managers. This updated Waiver Application form is available in our “Subscriber Forms” library, linked from the login page of REsearch.

Waiver applications are subject to review and approval by the HIS Board of Directors. All waivers are good for one year and must be renewed by June 30 each year for the following fiscal year.

July Billing Reminder & Schedule

As the July billing cycle is the largest of the year, we would like to remind you to make sure that your billing information is up to date. Credit card payments will be processed in mid-July.

If you have a payment due in July, please submit any changes to your billing and payment information by Friday, June 29, 2018. To change your billing payment plan or payment options, please submit the Billing/Payment Change Request Form:

If your payment method is by automatic credit card or ACH debit, please note that your card or bank account will be charged in mid-July, and not on the first business day of the month. This delay is due to the large number of payments processed in July, which is also taking place during our ongoing accounting system upgrade.

Lava Flow Housing Assistance Available

hir-rrfHawaii Island REALTORS® has announced a new housing assistance program for residents affected by the lower Puna lava flow, through funds from the REALTORS® Relief Foundation. The program helps with monthly mortgage expenses or rental costs due to displacement.

Assistance is for housing relief only, and is limited to a maximum of $1,700 per applicant per household. The application deadline is September 7, 2018. Please find the details, and the application form, on the HIR website:

Subscriber License and Access Agreement Update

We would like to first thank you for your assistance as we updated our copyright terms earlier this year through a one-time click-through acknowledgement in REsearch. We would now like to notify you that this change has also been incorporated into our standard Subscriber License and Access Agreement (SLAA).

Our updated SLAA is now in use for new members, and is available online (linked on the REsearch log in page) for your review:

Again, this amendment does not change your rights as they pertain to original text, photographs, or videos in your listings. It applies only to the compilation (the “selection, coordination, and arrangement” of data) in the MLS. You can find more information here.

If you accept the amended SLAA, no action is required. If not, you may contact us to request termination of your service.

Friendly reminder: If your office keeps local copies of our official forms to provide to new agents (including the SLAA and Exhibit C – Payment Agreement), please ensure you use the forms currently available online. We will be unable to process older versions of these forms.

Changes to the Criteria

 

top-100-gala-2018-04-croppedThe criteria used by Hawaii Business to determine its ‘Top 100’ and other lists is evolving along with the industry:

  • For This Year’s List: Sales of residential vacant land are now included in the main ‘Top 100’ list instead of only being included in a separate list.
  • For Next Year’s List: The buyer’s side of sales of new developments and new projects will be included.

REsearch Tip! To report the buyer’s side of a new development or new project sale when the seller is not a member of the MLS, use an Agent ID Code.
